As the information and communication technology regulator, one of NICTA’s principal functions is to approve and regulate the sale and use of radio-communications apparatus in PNG.

Importers, wholesalers, retailers, suppliers, distributors, dealers and the general public alike are advised that it is an offence under the Radio Spectrum Regulation 2010 to use, posses, import, sell or supply any unapproved apparatus including transistor radio receivers that operate outside of the PNG Spectrum Plan.

The penalty for committing the offence carries a fine not exceeding K 10, 000.00 and a person who fails to comply with any other requirement or direction given under the said regulation is guilty of an offence, which carries a penalty of a fine of K 10,000.00 per day for each day of noncompliance.

NICTA has become aware of certain imported brands of transistor radio receivers that operate outside of the PNG Spectrum Plan and are capable of receiving unapproved radio-communication signals. NICTA Radio Inspectors will be conducting random inspections on outlets and premises nationwide and confiscate unapproved transistor radio receivers.

The transistor radio receivers that have been manufactured with the capacity to receive radio broadcast signals outside the NICTA approved FM band 88.0 MHz to 108.0 MHz are not approved for use in PNG.

NICTA is allowing an amnesty period up to August 31, 2012 for the voluntary surrender of illegal transistor radio receivers, including but not limited to those listed below, and after which time any offender will be prosecuted for breaking the law.

This notice also applies to suppliers, dealers or owners of motor vehicles with illegal transistor radio receivers and other receivers installed therein.

Businesses, shop owners and the public are urged to cooperate and surrender all illegal transistor radio receivers and other apparatus to NICTA.
